The terms that govern your use of our website and services.

These Terms and Conditions ("Terms") govern your access to and use of the website www.byteharvests.com and the services provided by Byteharvest Services ("Byteharvest", "we", "us", or "our"), a business operating from Bengaluru, Karnataka, India. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Interpretation and scope
These Terms apply to all visitors and clients. The specific scope, deliverables, timelines and fees for any engagement are set out in a separate proposal, quotation or written agreement ("Service Agreement"). Where these Terms conflict with a signed Service Agreement, the Service Agreement prevails.
2. Our services
Byteharvest provides digital services including search engine optimisation, pay-per-click advertising, social media marketing, website design and development, content marketing, online reputation management, chatbots and automation, and analytics and reporting. We provide our services with reasonable skill and care and in accordance with applicable Indian law.
3. Quotations, fees and GST
All quotations are valid for the period stated within them. Unless agreed otherwise in writing, an advance payment may be required before work commences, with the balance payable according to the relevant Service Agreement. All fees are exclusive of Goods and Services Tax (GST), which will be added at the prevailing rate applicable to the services supplied.
Invoices are payable within the period stated on the invoice. We reserve the right to suspend work or withhold deliverables where payments are overdue.
4. Media and advertising spend
Where we manage paid advertising, media spend is separate from our management fees and is payable directly to the relevant platform unless agreed otherwise in writing. You retain ownership of your advertising accounts at all times. We are not responsible for platform policy decisions, account suspensions or pricing changes made by third-party advertising platforms.
5. Electronic acceptance
By accepting a proposal, confirming an order, or otherwise engaging our services electronically, you agree that such electronic acceptance constitutes a valid and binding agreement under the Information Technology Act, 2000.
6. Client responsibilities
You agree to provide accurate information, content, access and approvals in a timely manner. You confirm that any materials you supply (text, images, logos and other assets) do not infringe the rights of any third party and that you hold the necessary rights and licences to use them. You agree not to use our services for any unlawful purpose or in a manner that breaches Indian law, including laws relating to information technology, consumer protection, advertising standards and sector-specific advertising restrictions.
7. Revisions and approvals
The number of revision rounds included is specified in the relevant Service Agreement. Additional revisions or changes beyond the agreed scope may be subject to additional charges. Once deliverables are approved, further changes may be treated as new work.
8. Intellectual property
Upon full payment of all applicable fees, ownership of the final deliverables created specifically for you transfers to you, except for third-party materials, open-source components, stock assets, and our own pre-existing tools, frameworks and know-how, which remain owned by their respective owners or by us and are licensed to you for use in connection with those deliverables. We may showcase completed work in our portfolio and marketing materials unless agreed otherwise in writing.
9. Third-party services
Our services may rely on third-party platforms (hosting, domains, analytics, advertising networks and social media platforms). Your use of those services may be subject to their own terms, and we are not responsible for their availability, performance or policies.
10. No guarantee of results
Digital marketing outcomes depend on factors outside our control, including search engine algorithms, platform policies, competitor activity and market conditions. We do not guarantee specific rankings, traffic volumes, lead numbers or revenue. We do commit to applying reasonable skill and care and to reporting results transparently.
11. Cancellation and refunds
Either party may terminate an engagement in accordance with the relevant Service Agreement. Fees for work performed up to the date of termination remain payable, and advance payments may be non-refundable to the extent work has been carried out. Where you deal with us as a consumer, your statutory rights under the Consumer Protection Act, 2019 are not affected.
12. Limitation of liability
To the maximum extent permitted by Indian law, Byteharvest shall not be liable for any indirect, incidental or consequential loss, or any loss of profits, revenue, data or business arising out of or in connection with our services. Our total aggregate liability in respect of any engagement shall not exceed the total fees paid by you to us for that engagement in the twelve months preceding the claim.
13. Confidentiality
Each party agrees to keep confidential any non-public information disclosed by the other in the course of an engagement, and to use it only for the purposes of that engagement. This obligation survives termination.
14. Website use
The content on this website is provided for general information only and does not constitute professional advice. We may change or remove content at any time without notice. You may not copy, reproduce or redistribute our website content without our written permission.
15. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any dispute resolution process set out in a signed Service Agreement.
16. Changes to these Terms
We may update these Terms from time to time. The "last updated" date above reflects the most recent revision. Continued use of our website or services after a change constitutes acceptance of the revised Terms.
